1. in procedure, the plea at the end of the plaintiff's case that a prima facie case has not been made out and that the defendant should accordingly win.
2. in Scotland, the name given by the profession to the opportunity given by the Criminal Justice (Scotland) Act 1980 to the plea that the Crown case against the accused is insufficient in that it has not established sufficiently the necessary facts legally to constitute a crime of which the accused could be convicted under the complaint in question. A failure to provide corroboration will usually result in the plea being successful.
