Code of Practice
In the context of employment law, Codes of Practice are issued from time to time by official and government agencies such as the Advisory, Conciliation and Arbitration Service, the Information Commissioner, the Equal Opportunities Commission, the Commission for Racial Equality and the Disability Rights Commission. Failure by an employer to act in accordance with a Code of Practice does not of itself render them liable to any proceedings but such failure is admissible in evidence before an employment tribunal which may take it into account in determining any claim before them, such as whether an applicant has been unfairly dismissed or has suffered unlawful discrimination.
