A payment by a registered pension scheme that the Finance Act 2004 does not permit is an unauthorised payment. It may be a payment to a member or to one of the sponsoring employers. There is an automatic tax charge on unauthorised payments, known as the unauthorised payments charge, and in some circumstances an additional surcharge. If registered schemes make too many unauthorised payments in a tax year they may be liable for further tax charges and, ultimately, de-registration.
