Alcatel letter
England, Wales
A letter to be sent at the conclusion of a procurement to unsuccessful suppliers providing prescribed details of the tender evaluation scores. Each unsuccessful supplier is entitled to their own and the successful supplier's score. The standstill period does not start until the letters have been dispatched.
The requirement to provide these details was established in case of Alcatel Austria v Bundesministerium fuer Wissenshaft und Verkehr (C-81/98) and is now set out in Regulation 32 of the Public Contracts Regulations 2006 (SI 2006/5).
