public rights
rights enjoyed by persons as members of the public, as distinct from private rights attached to the personality of the individual or deriving from property owned by him. Public rights may derive from the common law (such as the right of members of the public to pass and repass along the highway) or from statute. In either case, the remedy for infringement is by indictment or in a rela-tor action for an injunction.
