A contract commonly used in real estate to transfer title and use of property from buyer to seller; does not include warranties against liens or encumbrances.

bargain and sale
n. A written contract to convey the legal title of, and raise a use in, real property in exchange for valuable consideration recited in the agreement without requiring the parties to enter the land and perform a livery of seisin.
Unless it includes a covenant of seisin and right to convey, the agreement contains no guarantees as to the seller's title to the property.
