Common, potentially anti-competitive agreements may fall within a "block exemption" - a general exemption from the need to notify the European Commission about agreements of a particular type where the conditions of the relevant block exemption are complied with. The Commission has introduced a number of block exemptions covering categories such as including exclusive distribution, exclusive supply and purchasing patent and know-how licensing and franchising. These typically set out restrictions which are permitted (a "white" list) and those which would render the block exemptions inapplicable (the "black" list). If the exemption is inapplicable, it is necessary to notify the agreement to the European Commission for specific exemption.
