opposition procedure
In the context of EC competition law, the procedure where agreements that fall outside a block exemption, because they contain provisions which are not expressly exempted, must be notified to the European Commission to obtain individual exemption. If the Commission does not oppose exemption within a period of four months the agreement is deemed to be covered by the block exemption.
In the context of UK competition law, if the Office of Fair Trading (OFT) adopts block exemptions containing an opposition procedure, an agreement notified to the OFT can be treated as exempt if the OFT has not raised any objection to it within a specified period.
EC Regulation 1/2003, which enters into force on 1 May 2004, will abolish the need to apply for an individual exemption, and hence the system of notifications.
