Under the Employment Rights Act 1996, compensation in an industrial tribunal for unfair dismissal may be composed of (1) a basic award based on a set formula according to age and years worked which can be increased in the case of failure to reinstate or re-engage; (2) a compensatory award to take into account loss of earnings and the like; and (3) a special award for failure to comply with a reinstatement or re-engagement order where the refusal on the grounds of union membership or non-membership or due to involvement as a union safety representative or on a union safety committee.
