Where approaches are made to possible infringers of your patents, design rights, registered designs and trade marks, the owner must avoid unjustified threats against the alleged infringer or others who may be involved. Hence the language of the letter should be limited to notification of the right and should be drafted by a specialist solicitor. If the approach does amount to a threat, the target of the threat may himself be able to bring action against the rights owner for the threat.
