In Scotland, it was held that a foetus born alive and surviving very briefly could sue for personal injury in the womb (Hamilton v . Fife Health Board 1993 SLT 624). An action against a solicitor for failing to raise an action for personal injury is not a personal injury action (MacKenzie v . Digby Brown 1992 GWD 191). In England, it has been held that an unplanned pregnancy was a personal injury (Watkin v . South Manchester Health Authority [1995] TLR 380).
