With literary, musical, dramatic and artistic copyright works, the author is the creator of work in terms of having used his skill, judgement and effort in making the work. As to photographs, it is the person who takes the photographs. For sound recordings and films, it is the person who made the arrangements necessary for the production. As to designs, the author or designer is the person who creates the design. If the design is computer-aided, the designer is the person who made the arrangement necessary for the design. Determining who is the author/designer is important under the Copyright Design and Patents Act 1988 as it determines initial ownership of rights and hence where assignment may be necessary.
