Under the Employment Rights Act 1996, compensation in an industrial tribunal for unfair dismissal may be composed of (1) a basic award based on a set formula according to age and years worked which can be increased in the case of failure to reinstate or re-engage; (2) a compensatory award to take into account loss of earnings and the like; and (3) a special award for failure to comply with a reinstatement or re-engagement order where the refusal on the grounds of union membership or non-membership or due to involvement as a union safety representative or on a union safety committee.

The second element of compensation payable to an employee found to have been unfairly dismissed by an employment tribunal (along with the basic award). The amount of the compensatory award will, subject to statutory limits, be such amount as the tribunal considers just and equitable in all the circumstances, having regard to the loss sustained by the employee because of the dismissal in so far as that loss is attributable to the employer's action.Related links
