Cash payments given to service users to purchase community care services they have been assessed as requiring. They are intended to give service users greater choice and flexibility in their care. Like community care, they are means-tested and therefore assume that most people will make a contribution to their care. The relevant duty is contained in the Community Care, Services for Carers and Children's Services (Direct Payments) (England) Regulations 2003 (SI 2003/762) and the Community Care, Services for Carers and Children's Services (Direct Payments) (Wales) Regulations 2004 (SI 2004/1748). These regulations are made under section 57 of the Health and Social Care Act 2001.
