A term used to define disability under the Title I and Title V of the Americans with Disabilities Act of 1990 (ADA) (42 U.S.C. §§ 12101-12113). One way an individual is recognized as having a disability under the ADA is if he has a physical or mental impairment that substantially limits one or more major life activities.
The Americans with Disabilities Act Amendments Act of 2008 (ADAAA) rejected the US Supreme Court's interpretation of substantially limits and directs the Equal Employment Opportunity Commission (EEOC) to issue regulations redefining the term consistent with the statute. The EEOC has issued proposed regulations that suggest a redefinition (see Regulations To Implement the Equal Employment Provisions of the Americans With Disabilities Act, as Amended (74 Fed. Reg. 48441 (proposed Sept. 23, 2009) (to be codified at 29 C.F.R. Part 1630)), but final regulations have not yet been released.
