congenital disabilities
in English law, injuries in respect of which action may be raised for a child born disabled in respect of a tortious act done to his parent before birth causing injuries: Congenital Disabilities (Civil Liability) Act 1976. The Act does not apply in Scotland, but the same result is achieved at common law: Cohen v . Shaw 1992 SLT 1022; Jones v . Lanarkshire Health Authority 1990 SLT 19.
