breach of trust

In the context of a trust, an act (or a failure to act) by a trustee, that is unauthorised, careless, or self-serving. A breach can occur in situations including when the trustee:
• Does something which is not authorised by the trust document or by trust law. For example, by distributing trust property to a beneficiary who is not entitled under the terms of the trust document, or by investing in property not permitted by their powers of investment.
• Does something (or neglects to do something) that is permitted by the trust document or by trust law, but in a negligent or careless way. For example, by investing trust funds in a highly speculative investment without proper consideration of the risks, or by failing to supervise an agent appointed to manage some part of the trust business.
• Does something in furtherance of his or her own personal interests (for example, by selling one of his or her own assets to the trust). This is often called the "self-dealing" rule.
