A power of attorney governed by the Mental Capacity Act 2005. A lasting power of attorney can grant authority for the attorney to make decisions in relation to the donor's property and affairs, or in relation to the donor's personal welfare. A lasting power of attorney in relation to the donor's personal welfare may not be used until the donor loses capacity (or the attorney reasonably believes that the donor has lost capacity). Before it can be used, a lasting power of attorney must be registered with the Office of the Public Guardian.
