Technically a process rather than a particular claim or remedy. Tracing may provide an equitable process for the claimant to receive property which he has unjustly lost to a knowing recipient. This may be of use to recover money paid to a fiduciary under a mistake. Money may be traced, provided that it can be identified or disentangled where it has been mixed with other assets of the recipient. For example, a lender in an ultra vires loan transaction is entitled to a tracing order or, in the case of a mixed fund, a declaration of charge, if the money lent can be traced into any investments or other property held by the company, or held by a volunteer having no better equity.

fraud,
misappropriation, or mistake. The remedy is also used in
bankruptcy, commercial transactions, and property disputes in marital dissolution cases.
